Terms & Conditions
1. Who we are and what these terms cover
These terms apply to every quote, order and delivery by Point of View 360 ("we", "us"). They apply to all three of our services: location and storefront video, engraved NFC review trays, and printed takeaway review stickers. By placing an order you accept these terms. Anything we agree in writing that differs from them takes precedence over them.
2. Quotes and orders
Prices shown on this website are indicative and exclude VAT unless stated otherwise. An order becomes binding once we confirm it in writing, by e-mail or by WhatsApp. For custom engraved or printed products we send a digital proof first. Production starts only after you approve that proof, and the approved proof is what we produce.
3. Delivery
We aim to deliver within five working days of proof approval, or of the shoot in the case of video. That aim is not a guaranteed deadline. Weather, airspace restrictions, illness, supplier delays and force majeure can move it, and we tell you as soon as we know. Delivery is to the address or e-mail address you give us.
4. Payment
Unless agreed otherwise, invoices are due within fourteen days of the invoice date. Custom physical products may require payment in advance. Goods remain our property until paid in full.
5. Your material and your rights
If you supply a logo, artwork, a font or any other material, you confirm that you are entitled to use it and to let us use it for your order. You indemnify us against third-party claims arising from material you supplied.
6. Our material and rights of use
We keep the copyright in the footage, images and designs we create. On full payment you receive an unlimited, perpetual licence to use the delivered files for your own business: website, social media, advertising, printed matter and in-store use. You may not resell them or pass them to third parties as stock material. We may show the work in our own portfolio and on our social media unless you tell us in writing that you would rather we did not.
7. Filming on location
We fly under the EU open category with a valid A1/A3 licence and a registered operator number, and we follow the rules that apply at the location, including no-fly zones and any permit the municipality requires. If a shoot cannot go ahead safely or lawfully on the day, we reschedule it at no extra cost. Making sure we can access the premises, and obtaining the permission of anyone whose property appears, is your responsibility.
8. Review products, and what we do not promise
Our trays and stickers make it easy for a guest to reach your review page. We do not buy, write, incentivise or filter reviews, and we never promise a number of reviews or a particular rating. Google's own policies apply to every review left through our products, and we build the products so they can be used within those policies. Do not offer a discount or a gift in exchange for a review; that breaches Google's rules and can cost you your reviews.
9. NFC and QR technology
NFC chips and QR codes work with the great majority of current phones, but we cannot guarantee every device, operating system or camera app. The target of a scan link can be changed by us at your request at any time, and printed codes keep working when it changes.
10. Complaints, returns and cancellation
Tell us within fourteen days of delivery if something is wrong, and we repair, replace or refund the affected part. Custom-made goods that are produced to your approved proof cannot be returned, which is the statutory exception for personalised products. You may cancel an order before we start production; if work or material costs have already been incurred we may charge those.
11. Liability
Our liability is limited to the invoice value of the order concerned, and to direct damage. We are not liable for indirect or consequential loss, including lost turnover or lost reviews. Nothing in these terms limits liability for intent or gross negligence.
12. Applicable law
Dutch law applies. Disputes go to the competent court in the district of Midden-Nederland, unless mandatory law says otherwise. If a clause in these terms turns out to be invalid, the rest stays in force.
